This Privacy Policy (“Policy”) governs the processing of personal data by Green and Efficiency Services Real Estate Solutions spółka z ograniczoną odpowiedzialnością spółka komandytowa spółka komandytowa and its capital‑ and organisationally‑related entities (“Adgar”, “we”) in connection with: 

• your visit to our website available at https://adgar.pl (the “Service”); 
• your interaction with us in any other manner, in particular during conversations and correspondence. 

This Policy contains information on the processing of personal data by Adgar and in particular: 

• identifies the types of personal data we collect; 
• explains how and why we collect and use your personal data; 
• explains when and why we share personal data with other entities; and 
• explains the rights and choices you have in relation to your personal data. 

This Policy applies if: 

• you are a Service visitor, i.e. you browse the Service or contact us via the contact form; 
• you are a marketing recipient, i.e. you have subscribed to our Newsletter or consented to receive marketing communications; 
• you are a Contractor, i.e. you provide us with products or services, use our services, or cooperate with us on joint projects; 
• you are a Contractor’s Representative, i.e. you represent an entity providing products or services to us, using our services, or cooperating with us on joint projects. 

Your personal data is processed in accordance with:

III. WHAT INFORMATION DO WE COLLECT? 

Service visitors 

We collect information during your use of the Service, conversations, e‑mail correspondence, and when you complete the contact form. This may include in particular: first name, last name, correspondence address, e‑mail address, and phone number. 

Marketing recipients 

We collect information provided in the newsletter form, registration form, and during your use of the Service, including: first name, last name, e‑mail address, other contact details, and device data. 

Contractors 

We collect information provided in documents, forms, e‑mails, conversations, and meetings, including data necessary to conclude and perform contracts, such as: first name, last name, e‑mail address, phone number, company name, business address, PESEL, NIP, REGON, and bank account number. Data may also come from public sources. 

Contractors’ Representatives 

We collect data provided in documents, forms, conversations, and correspondence, including: first name, last name, contact details, job title, and data of the entity represented. Data may also be provided by the represented entity or obtained from public sources. 

IV. WHY AND ON WHAT LEGAL BASIS DO WE PROCESS DATA? 

Service visitors 

• performance of an electronic services agreement (Article 6(1)(b) GDPR); 
• legitimate interests of Adgar, including Service operation, security, responding to enquiries, reporting, administrative and marketing purposes (Article 6(1)(f) GDPR). 

Marketing recipients 

• based on your consent for marketing activities such as newsletters (Article 6(1)(a) GDPR). 

Contractors 

• performance of contracts (Article 6(1)(b) GDPR); 
• legal obligations, including tax and accounting requirements (Article 6(1)(c) GDPR); 
• legitimate interests related to business operations, marketing, and legal claims (Article 6(1)(f) GDPR). 

Contractors’ Representatives 

• legitimate interests related to contract execution, business relations, and legal claims (Article 6(1)(f) GDPR). 

V. WHO DO WE SHARE YOUR DATA WITH? 

We may share your data with: 

• entities authorised under applicable law; 
• data processors acting on our behalf (e.g. IT service providers, advisory firms); 
• entities affiliated with us capital‑ or organisation‑wise. 

Data transfers outside the EEA may occur, especially to Israel. In such cases, e ensure an adequate level of data protection, including compliance with he European Commission Decision 2011/61/EU confirming Israel’s adequate data protection level. 

VI. DATA RETENTION PERIODS 

• Service visitors – for the duration necessary to operate the Service and respond to enquiries; 
• Marketing recipients – until consent is withdrawn; 
• Contractors and their Representatives – for the duration of the contract and afterwards as required by law (e.g. accounting obligations, limitation periods).

• request access to, rectification, erasure, or restriction of your data; 
• request data portability; 
• object to processing based on legitimate interests; 
• lodge a complaint with the Polish Data Protection Authority.

VIII. IS DATA PROVISION MANDATORY? 

Providing your data is voluntary but necessary to: 

• respond to enquiries; 
• provide Service information; 
• deliver newsletters and marketing materials; 
• provide electronic services. 

If you are a Contractor’s Representative, your data may come from the entity you represent or public sources.
